Terms of Service

Under Section 6 of Law 2004-575 of June 21, 2004 for confidence in the digital economy, users of the website www.scojelis-tech.com (hereafter the “Site”) the identity of the various stakeholders during its implementation and follow-up:

The Site is a website for the presentation of the “SCOjelis” web application. It aims to present the features of the SCOjelis service, to bring information to users, which are  mainly  industrial companies, communities and organizations  that own a supply chain.   SCOjelis is a set of services, including on the one hand a consulting offer in supply chain expertise,and onthe other a web interface to visualize the data  imported by the customers of the service.

The purpose of these terms and conditions of use (the “CGUs”) is to define the contractual relationship between the Company and any user of the Service (the “Users”) on the other.

The use of the Site implies full acceptance of the following CGUs described. These CGUs are subject to change or completion at any time; Users of the Site are therefore invited to consult them on a regular basis.

The Site is normally accessible at any time by Users. However, an interruption due to technical maintenance may be decided by the Company, which will then endeavour to communicate to Users the dates and times of the intervention.

The Site is updated regularly automatically or by the staff in charge of the Site.

The purpose of the Site is to define:

  • The terms and conditions under which any major natural person acting in a professional and non-professional capacity and located on French territory can subscribe to the Company for a subscription to the SCOjelis service, both for the provision of consultation and access to the web interface (hereafter the “Application”);
  • How the Application works and the conditions under which users can use the App.

The Company strives to provide as accurate information as possible on the Site.

However, the Company cannot be held responsible for omissions, inaccuracies and deficiencies in the update, either as a result of the Company’s or the third-party partners who provide this information.

All information on the Site is given as an indication, and is likely to change. In addition, the information on the Site is not exhaustive. They are given subject to changes that have been made since they were put online.

The Site uses JavaScript technology.

The Website cannot be held responsible for property damage related to the use of the Site.

In addition, the Site User agrees to access the Site using new, non-virus-free hardware and with a state-of-the-art browser.

The Company owns the intellectual property rights or holds the rights to use all items available on the Site, including texts, images, photographs, graphics, videos, logo, icons, sounds, software.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, regardless of the means or process used, is prohibited, unless express and written prior permission from the Society.

Any unauthorized exploitation of the Site, or any of the elements contained in it, will be considered to constitute infringement and prosecuted in accordance with the provisions of Articles L.335-2 and the following of the Intellectual Property Code.

These CGUs are subject to French law.

In the event of a dispute, the parties will seek an amicable solution before any legal action is taken. If these attempts fail, any challenges to the validity, interpretation and/or enforcement of these CGU will have to be brought even in the case of plurality of the defendants or an appeal for guarantee, before the competent French courts.

The Company cannot be held liable for direct and indirect damage to the User’s equipment during access to the Site, resulting either from the use of equipment that does not meet the specifications specified in Article 4, or from the occurrence of a bug or incompatibility.

The Company may also not be held liable for any indirect damages resulting from the use of the Site.

Interactive spaces (possibility of asking questions in the contact area) are available to users. The Company reserves the right to remove, without prior notice, any content deposited in these spaces that would contraviment from applicable legislation in France, in particular to data protection provisions. If necessary, the Company also reserves the possibility of questioning the user’s civil and/or criminal liability, in particular in the case of messages of a racist, offensive, defamatory, or pornographic nature, regardless of the medium used (text, photography, etc.).

In France, personal data is protected by Law 78-87 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L. 226-13 of the Penal Code and the European Directive of 24 October 1995.

In accordance with the provisions relating to computers, files and freedoms, visitors to the Site have the right to access, rectify and object to the transfer of the information transmitted to the Company. The Company specifies that no data is collected without your knowledge, as the Site does not collect any personal information relating to the User.

The Site contains a number of hyperlinks to other sites, set up with the Company’s permission. However, the Company does not have the ability to verify the content of the sites visited in this way, and will therefore not assume any responsibility for this fact.
